MYSTERY BOXES WILL BE SHIPPED IN 10 DAYS - FIRST CLASS POSTAGE UNAVAILABLE ON THESE ITEMS. REFUNDS ARE NOT GIVEN IF THIS OPTION IS CHOSEN AT CHECKOUT.

RETURNS

ALL KICKS FORCE SALES ARE FINAL. NO CANCELLATIONS OR REFUNDS ARE ACCEPTED, WITH THE EXCEPTION OF FAULTY ITEMS RECEIVED.

 

TERMS AND CONDITIONS

1. General:

1.1 All products are pre-loved - sold as seen- description will dictate any large imperfections/ lack of box;

1.2 We are not affiliated with brands sold - all products are sourced independently;

1.3 Authenticity guaranteed - legitimacy of shoes will be determined via checkcheck. receipts available upon request.

1.4 Clothing items undergo independent sourcing and legitimacy checks; therefore, receipts may not be available.

2.3 We may contact you, if necessary, regarding changes or updates with your order using the email address and contact number that you provide at checkout.

3. Orders

3.1 Orders are classified as “accepted” when the buyer receives a confirmation email and order number, from here on there is a contract between Kicks Force Ltd and the buyer;

3.2 If we are unable to fulfil your order due to an error on our part (such as an error in price or description of the item), you will be contacted and refunded for your order;

3.3 Without a confirmation email from us, and a subsequent order number, your order has not been completed. Any pending transactions will be void and cancelled shortly after attempting purchase. This can occur due to high traffic on the site, use of bots and other automated devices.

3.4 Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

3.5 We strive for accuracy, however subjective independent checks may occasionally lead to authenticity errors. In such cases, refunds will be provided.

 

4. Products

4.1 We strive to deliver a seamless website experience with lack of technical difficulties, however, when demand is high we cannot guarantee that availability of items will be displayed accurately. Without a confirmation email from us, and an order number, your order has not been successful and any transactions will be cancelled by the payment provider;

4.2 Images of items will be shown on the product page, with any major imperfections highlighted. However, as all products are pre-loved, all items may come with general signs of wear;

4.3 We are happy to send more pictures of items upon request.

4.4 Mystery box items will be of great-excellent quality with no large imperfections. We will adhere to brand sizing, e.g., if L is stated in the label this is what it will be listed as. We are not responsible for differences in sizing between brands.

5. Delivery

5.1 We are based in the United Kingdom. Shipping prices to the buyers address will be automatically calculated by Royal Mail at checkout;

5.2 We aim to ship all orders as soon as possible, however the shipping time guidelines states are an estimate. Once your order has been dispatched, you will receive an email update with tracking information;

5.3 In the event that you are not home when delivery is attempted, Royal Mail will reattempt delivery. Failure to accept the item will result in Royal Mail returning the item to the seller (Kicks Force Ltd), for which we will not offer compensation or refund;

5.4 The product that you have purchased becomes your responsibility once delivered to the address given at checkout;

5.5 Ownership of the product is yours after we have received full payment for product and delivery;

5.6 We are not liable for any delays in shipping outside of our control. We will ensure to keep you updated with any information we have regarding such delays. In the event of a substantial delay, you may contact us to terminate the contract and receive a refund for any products paid for but not received.

6 Customs

6.1 As stated in the shipping information, please be aware that customers outside of the UK may incur additional customs duties or taxes or other customs requirements. Any such customs duties or taxes may be significant and so please ensure you confirm the position before placing your order. We are not responsible for any such customs duties, taxes or requirements, nor are we responsible for any parcels returned for unpaid customs duties or taxes or non-compliance, and we will not issue refunds under these circumstances;

6.2 Third party providers will contact you to collect payment of relevant customs tax and charges. In the event Kicks Force Ltd receives this information, it will be forwarded to you that same day;

7. Payment

7.1 The price of both your order and postage will be in pounds sterling (GBP) and will be indicated during the checkout. We accept Visa, Visa Debit, Mastercard and PayPal;

7.2 The price for international sales (outside of the UK) excludes potential customs fees, charges and taxes required by your country for import of the product. Please see clause 6.1 and 6.2 for customs related conditions.

8. Returns and exchange

8.1 Kicks Force Ltd does not accept return or exchange of products, unless the item is faulty (Not including any imperfections shown in the listing and/or description). In the case of a faulty item, please contact us and we will arrange return of the item to us and the refund of all payment and postage.

9. STATUTORY RIGHT TO CANCEL

Please note, cancellation policy excludes the statutory right to cancel.

If you are a customer in the UK, EU or in Norway, Liechtenstein or Iceland, you have a statutory right to cancel any order you place with us within 14 days of receiving your order as set out in this clause 7. This is an additional and separate right to our returns policy. You may choose either method to return orders.

9.1 To cancel, you must inform us within 14 calendar days of the day on which you receive the product. You can contact us via email at kicksforce.official@gmail.com;

9.2 You must return the product to us in perfect original sale-able condition in the original packaging and with all tags attached within 14 calendar days of telling us you wish to cancel. You are responsible for any return shipping charges. For your protection, please be sure to return your products via recorded or registered post.

9.3 We will refund you the price you paid for the products, together with any outbound delivery costs, by the method you used for payment. However, we may make deductions from the price (excluding delivery costs) to reflect any reduction in the value of the products, if this has been caused by your handling them in a way which means they are not in perfect original sale-able condition in the original packaging and with all tags attached. If we refund you the price paid before we are able to inspect the products and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.

9.4 Refunds will be given up to 14 days after the day on which we receive the product back from you.

10. Terminating contract

10.1 We may end the contact agreement with you in writing (email) at any time if:

              10.1.1 The payment has not been paid in full.

              10.1.2 You do not allow delivery of the item, causing it to be returned to us.

11. Our responsibility for loss or damage suffered by you

11.1 You have certain rights under the law, including that any products you order through this website will be of satisfactory quality, fit for their intended purpose, and will conform to your order and any description given on this website. Nothing in these terms and conditions will affect your legal rights;

11.2 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen;

11.3 We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, loss of goodwill, business interruption or loss of business opportunity (and in each of these cases whether the losses suffered are direct or indirect). This is subject to paragraphs 11.1 and 11.4;

11.4 Loss and damage that is not limited by us. Nothing in these terms and conditions will have the effect of limiting or excluding our liability (i) for death or personal injury caused by our negligence, or (ii) fraudulent misrepresentation, or (iii) any other liability which cannot be excluded or limited under applicable law, such as your legal rights referred to in paragraph 11.1 above.

12. Other

12.1 We may change our terms and conditions on occasion;

12.2 We may transfer our rights and obligations under these terms to another organisation or deal with them in any other way that we consider appropriate;

12.3 You may only transfer your rights or your obligations under these terms to another person;

12.4 Nobody else has any rights under these terms and conditions. This contract is between you and us. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms;

12.5 If a court or relevant authority finds part of these terms are unenforceable, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect;

12.6 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date;

12.7 These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
